TERMS OF SERVICE

                                                                                                   

        GENERAL DISPOSITIONS

 

    Commissions are delivered in one of the following digital formats: .png, .jpeg, or .gif. We do not supply printable works or editable     

documents originating from the Design Software.

   The illustration will be delivered through digital means by which the Client and Artist have both agreed upon. Communications may include but are not limited to: email, DeviantArt note, Discord and/or Download link.

   The illustration will be delivered at a low resolution with a small watermark when dealing with personal or private works in case the client share it in social media. The client will be provided with the appropriate size without a watermark as stated by the commission.

   Once the final illustration is delivered it is the full responsibility of the client to save the file appropriately.

   The client automatically agrees to these terms of use when choosing any of our commission types.

       IMAGE USAGE

​

   We reserve the right to design illustrations with any of the following topics:  Hentai, Nude, Gore, Topics that promotes hate, Suicide, Extreme violence, Yaoi, Yuri,  Topics directly related to religion.

​   As artists we reserve the right to decline any commission that is not bound to our design aesthetic or that incorporates any topic from those aforementioned.

   Once the digital file is provided, the use of the image is the full responsibility of the client, the artist is exempt of any responsibility that comes from the usage of the illustration.

 

      PROPERTY

​

   At purchase completion, the artist yields property rights to the client and the responsibility for the use of the illustration. The client will have the liberty to reproduce the image via printable or digital medium.

   The artist reserves the right to share the illustration on social media for future reference, unless previously stated otherwise by the client.

   The client must inform the artist, at the time of the request, if they would like their piece not to be distributed by the artist on social media, art sites or others.

   The client may not, under any circumstances, take credit for the creation of the commissioned piece.

 

     USES

​

   The client must explicitly disclose the end use of the commissioned piece (whether for private or commercial use) at the time the work is requested. The commissioned piece may not be used for other purposes than otherwise stated at the time of the request. The artist reserves the right not to create something based on fan art for commercial purposes.

 

         Commercial Use

   Commercial use it is understood like activities performed by the client may focus on creation of economic value stemming from the commissioned illustrations.

   The illustrations for commercial use will be delivered without a watermark, the artist acknowledges the use and exploitation of the piece for commercial purposes by the client.

   Before starting the commission, the client must expressly point out the end use of the chosen illustration.

   The artist reserves the right not to create something based on fan art for commercial purposes.

 

        Personal or Private Use

   Illustrations created for personal or private use are to be used solely for educational, fun, or reference purposes.

   The artist will not be responsible for the way the client utilizes the artwork.

   The client will have the power to use the artwork for printing and digital media, as determined by the client and excludes the artist of any link from the work.

   Mentions (for the work created by the artist) are greatly appreciated when the client deems convenient.

 

 

     COSTS

Commissions start at a base price beginning with the artwork style, specified on the next page:

​The design inquiry and first (rough) sketch are free.

PROCESS

STEP 1: Please fill out the form with as much details and references as much as possible. Please fill out 1 form for each different/separated commission.

STEP 2: You will get an e-mail from us with the total price of your drawing, please review carefully, if you have questions please ask them in this step by e-mail.

STEP 3: Once you agree with the terms and price we consider the process started and we will back to you with the rouge sketch. This sketch will be small size and watermarked.

STEP 4: SKETCH

When you get the rouge sketch and you decide to continue with the process. We will send you the payment request (invoice) and when the payment be completed we will apply changes to the sketch if need it. Please send the info about all the changes in one e-mail so we can apply them together. All the changes will be to fit/complete the first description you sent.
â–º Accepted changes:
General pose, general expression, items, outfit details.
X Non Accepted changes:
Any change different to the description.
Changes totally different from the description will have an extra cost if you want them to be applied.

STEP 5: LINEART

Once you agree with the sketch the lineart will be started. When you get the lineart (small size and watermarked) you can ask for changes in smaller details, it means parts you didn't saw clearly in the sketch.
â–º Accepted changes:
Finer details of background, attire, and those relating specifically to the character such as proportions and expression.
X Non Accepted changes:
Pose or attire such as removing or adding items and or accessories not mentioned in the original description (if any part of the piece needs to be re-drawn, extra costs will incur depending in the complexity of the modification).

STEP 6: FLAT COLORS

Once you agree with the lineart we will back to you with the flat colours in a small size and watermarked. You can ask for tone changes and/or colour corrections.
â–º Accepted changes:
Changes in tones/saturation/color intensity, as well as errors made in the representation of colors mentioned in the general description, also pattern corrections.
X Non Accepted changes:
Changes from one colour to a completely different colour (for experimentation).

STEP 7: FINAL DETAILS

When you agree with the flat colours we will back to you with the finished coloring.
You will get it in full size in format .png. In case of animations woudl be .gif or .mp4.
If paying in 2-part installments, before the second payment you will get a smaller, watermarked image. Once the final payment has been completed product will be delivered in full size without the watermark.
You can ask for only small changes.
â–º Accepted changes:
General contrast, general (unified) scene tones, saturation/brightness and small effects.
X Non Accepted changes:
Any change that requires any part of the illustration to be redrawn or re-colored. If changes are requested, extra costs will be incurred.

We reserve right to make no changes in this case.

STEP 8: With the finished piece delivered you will get an email from us to notify you about the end of the process

    REFUNDS

A refund can be obtained under the following criteria:

Mutual agreement between the artist and the client.

If the artist goes more than 96 hours without responding to the client.

In the case that the artist decides they are unable to continue the commission.

Refunds will be calculated based on the percentage of work already completed, please see the chart below.

     CHANGES ACCEPTED PER STEP

 

            Sketch

The first version of the rough pencil sketch is free and will be delivered watermarked and in low resolution compared to the final product.

â–º Accepted changes:

The first idea presented by the client (sketch) is free. Any changes means the user accepts the commission and the process beggin with the payment.

x Non Accepted changes:

Any change to first sketch results in a cost for working in the commission; with a refund of 80% .

            Lineart

Delivered with watermark and low resolution compared to the final product.

â–º Accepted changes:

Finer details: background, attire, and those relating specifically to the character such as proportions and expression. 

x Non Accepted changes:

Pose or attire such as removing or adding items and or accessories not mentioned in the original description (if any part of the piece needs to be re-drawn, extra costs will incur depending in the complexity of the modification).

Note: If the client still want this kind of changes can be made adding an extra cost.

            Flat Colors

Delivered watermarked and in low resolution compared to the final product.

â–º Accepted changes:

Changes in tones/saturation/color intensity, as well as errors made in the representation of colors mentioned in the general description.

x Non Accepted changes:

Changes from one color to a completely different color (for experimentation).

Note: If the client still want this kind of changes can be made adding an extra cost.

            Final Product

Delivered in full size.

If paying in 2-part installments, before the second payment a smaller, watermarked image will be delivered. Once the final payment has been completed product will be delivered in full size.

â–º Accepted changes:

Shadow intensity, general (unified) scene tones, saturation/brightness and effects.

x Non Accepted changes:

Any change that requires any part of the illustration to be redrawn or re-colored. If changes are requested, extra costs will be incurred.

We reserve right to make no changes in this case.

 

The client accepts that after 15 days, beginning from the date the final product was delivered, no changes of any kind will be made without incurring an extra charge and/or we reserve right to make no changes.

Once the final product has been dispatched, a “manual delivery” update will be noted in PayPal without requesting delivery data thus ending the transaction.
